Ecuador - Municipal elections and referendum vote deal blows to Lasso

Greater instability and early elections are more likely due to the loss. 

Ecuador’s Sunday elections and referendum vote produced significant losses for President Guillermo Lasso. The loss makes greater instability and the probability of early elections more likely in the country.

Candidates backed by former president Rafael Correa won mayoral races in Quito and Guayaquil, the country’s two most populous cities. The eight questions on the popular referendum promoted by Lasso are all set to fail according to the most recent vote count.

Despite his low approval ratings, Lasso was willing to take a risk calling for a referendum because he hoped that public discontent with the legislature would have a larger impact on voters than their disapproval of him. The fact that voters did not eagerly vote to reduce the power of the legislature and political parties nor approve harder-line security policies following a year of record violence demonstrates just how unhappy with Lasso the Ecuadorian public has become. 

Rather than creating pathways to circumvent obstructionism from the opposition, calling the referendum simply cemented Lasso’s dwindling legitimacy. The president only barely survived an impeachment vote already, and the Ecuadorian opposition will certainly feel emboldened by the results of Sunday’s vote. Lasso struggled to negotiate with opposition and indigenous during the June 2022 protests, and his loss of credibility from Sunday’s vote will grant these groups more leverage in any future conflict. 

The results were generally driven by the same anti-incumbency trends seen around the region. Nobody should read these results as a pro-Correa wave. Former President Correa’s candidates won mayoral elections because of divided fields in an anti-incumbent environment. And the two candidates who won in Quito and Guayaquil aren’t from the corrupt inner circle that defined Correa’s government. They are relatively new faces. In both cases, pragmatism at the municipal level is a likely outcome.

This election loss means Ecuador is very likely to see another round of protests in the coming months by indigenous activists and anti-Lasso leftists who will be emboldened to take on the government. There isn’t a clear spark for those protests at the moment, but any changes in fuel prices or other economic subsidies would be enough reason for the protesters to return. 

And it’s more than 50% likely (though not certain) in the coming 12 months that Lasso uses the “muerte cruzada” option of calling early presidential and legislative elections. It’s the last big political tool he has remaining and his opponents are less likely to fear new elections given their strong showing during the municipal elections this Sunday. The only reason for Lasso to hesitate on new elections is the likelihood his opponents would win it. However, if he’s a lame duck facing a likely new impeachment vote by the legislature (and they will attempt it again), the president might as well use the one weapon he has remaining

Ecuadors Präsident Guillermo Lasso hat am Montag (06.) seine Niederlage im sogenannten Auslieferungsreferendum akzeptiert. Das Auslieferungsreferendum, eine von acht Reformen auf dem Stimmzettel, hätte es ermöglicht, verdächtige Ecuadorianer ins Ausland zu schicken, um ihnen dort unter anderem wegen Drogen- und Waffenbesitzes den Prozess zu machen. Lasso befürwortete die Änderung als Mittel zur Eindämmung der Kriminalität, für die seine Regierung den grenzüberschreitenden Drogenhandel verantwortlich macht. „Ich akzeptiere, dass die Mehrheit nicht damit einverstanden ist, dass diese Fragen mit den im Referendum vorgeschlagenen Instrumenten gelöst werden“, so Lasso in einer Radio- und Fernsehansprache.

Der unpopuläre Machthaber, ein ehemaliger rechter Banker, rief zu einer „breiten und ernsthaften Debatte ohne Dogmen und Ideologien darüber auf, wie man der heutigen Bedrohung durch den Drogenhandel und seine Verbindungen zu politischen Sektoren begegnen kann“. Im Rahmen des Referendums schlug Lasso erfolglos politische, ökologische und sicherheitspolitische Reformen vor, während die Gewalt in einem noch nie dagewesenen Ausmaß zunahm. Und das war nicht der einzige Rückschlag für den Präsidenten. Die Bürgermeisterämter der wichtigsten Städte, Quito und Guayaquil, wurden von den Kräften des linksgerichteten ehemaligen Präsidenten Rafael Correa (2007-2017) gewonnen. Der Ex-Präsident bleibt im Spiel, obwohl er seit sechs Jahren in Belgien lebt, wo er Asyl erhalten hat und in seinem Heimatland im Jahr 2020 wegen Korruption zu acht Jahren Haft verurteilt wurde. Auch von Europa aus warb er für die Ablehnung des Referendums.

Dollar bonds of Ecuador dropped by over 10% with its 5.5% 2030s falling over 10 points to 59.93, yielding 19.3%. This comes after partial results from the constitutional referendum showed that voters were planning to reject a series of proposals put forward by President Guillermo Lasso. Bloomberg notes that the preliminary results defied polls which predicted a broad approval of the constitutional amendments that included a change that would allow extradition of drug traffickers. Here, 95% of votes have been tallied, and a majority of 51.5% have so far rejected Lasso’s proposal.

Katrina Butt, an economist for EM at AllianceBernstein said, “If the results hold, it’s not a good outcome for Lasso. The market is starting to price a worst case scenario: Lasso loses the election, then Assembly turns against him more, then there’s renewed impeachment talk.” Analysts also note that the results could significantly increase the headline and political risk, further weighing on the rating of the sovereign’s debt.

Ecuadorian President Guillermo Lasso Monday admitted defeat in Sunday's referendum through which he intended to garner enough consensus for the remainder of his term after 18 months in office. Citizens were asked, among other issues, to decide whether national offenders could be extradited abroad to face drug-trafficking charges. Lasso favored the idea, a slim majority did not with 47% of the votes counted.

“I accept that the majority does not agree that those issues are resolved with the tools put to consideration in the referendum,” Lasso said in a radio and television statement. The former right-wing banker had called for “a broad and serious debate, without dogmas or ideologies, about how to confront the threat that drug trafficking and its links with political sectors represent today.”

In addition to losing the referendum, the opposition leftwing Citizen Revolution party of former President Rafael Correa (2007-2017) won the mayoralties of Quito and Guayaquil, also at stake last Sunday. Correa, who has been sentenced in 2020 to eight years in prison for corruption, had called from his Belgium exile to vote against Lasso's proposals.

In the key question on extradition, the Nays obtained 51% of the valid votes against 49% of the Yes, according to preliminary results released by the National Electoral Council (CNE), thus contradicting a Cedatos poll from the previous week whereby 66% of Ecuadorians were in favor of extradition.

In addition to the referendum, Ecuadorians elected some 5,700 local authorities in a process marked by the violence which plagues the country due to drug trafficking and which left two mayoral candidates dead. Correism won at least seven of the 23 provincial prefectures, including those of Guayas and Pichincha. It also won the mayoralties of Quito and Guayaquil, the port that for 30 years was a right-wing stronghold.

“Although we continue to believe in the axes of this consultation, it is also true that the future welfare of Ecuador did not and does not depend exclusively on it,” said Lasso, who barring any unforeseen event will rule the South American country until 2025.

Correist candidates won the strategic mayoralties of Quito and Guayaquil, in addition to the prefectures of seven of the country's most populated provinces. Sunday's regional and municipal elections, which still do not have a definitive result, are seen as a projection for the 2025 presidential elections.

According to official data from the National Electoral Council (CNE), Pabel Muñoz triumphed with 25.2% of the votes for mayor of Quito, while in Guayaquil, with 93.6% of the votes counted, Aquiles Álvarez received 39.7% of the votes. The results in Guayaquil, Ecuador's economic center, represent a hard blow for the right-wing Social Christian party, which had been in the municipal administration for 31 years. The candidates of Revolución Ciudadana also took the lead in some of Ecuador's most populated provinces. Thus, in Pichincha, with the total number of votes counted, Paola Pabón obtained 27.9% of the votes, while in Guayas, with 93.2% counted, Marcela Aguinaga consolidated first place with 34.4%.

Nach Auffassung des BFH bewirkt die gesetzlich vorgesehene Verlustverrechnungsbeschränkung eine verfassungswidrige Ungleichbehandlung, weil sie Steuerzahler ohne rechtfertigenden Grund unterschiedlich behandelt - je nachdem, ob sie Verluste aus der Veräußerung von Aktien oder aus der Veräußerung anderer Kapitalanlagen erzielt haben.

Verrechnungsbeschränkung für Aktienverluste: Ministerium nimmt neue Vorläufigkeit in Steuerbescheide auf

Einkommensteuerbescheide ergehen ab sofort vorläufig hinsichtlich der Frage, ob die Verlustverrechnungsbeschränkung für Aktienveräußerungsverluste verfassungsgemäß ist. Der neue Vorläufigkeitsvermerk wird sämtlichen Einkommensteuerfestsetzungen ab dem Veranlagungszeitraum 2009 beigefügt, zu denen ein Verlust aus Kapitalvermögen (im Sinne des § 20 Abs. 2 S. 1 Nr. 1 S. 1 EStG) aus der Veräußerung von Aktien festgestellt wird, weil ein Ausgleich mit anderen Einkünften aus Kapitalvermögen nicht möglich ist.

Die neue Vorläufigkeit wurde geschaffen, weil der Bundesfinanzhof (BFH) dem Bundesverfassungsgericht die Frage vorgelegt hat, ob es mit dem Grundgesetz vereinbar ist, dass Verluste aus der Veräußerung von Aktien nach der Änderung durch das Unternehmensteuerreformgesetz 2008 nur noch mit Gewinnen aus der Veräußerung von Aktien und nicht mit sonstigen positiven Einkünften aus Kapitalvermögen verrechnet werden dürfen.

Hinweis: Das Unternehmensteuerreformgesetz 2008 hat die Besteuerung von Kapitalanlagen des steuerlichen Privatvermögens grundlegend neu gestaltet. Durch die Zuordnung von Gewinnen aus der Veräußerung von Kapitalanlagen (wie Aktien) zu den Einkünften aus Kapitalvermögen wurden die dabei realisierten Wertveränderungen (Gewinne und Verluste) in vollem Umfang und unabhängig von einer Haltefrist einer Besteuerung ausgesetzt. Da Einkünfte aus Kapitalvermögen grundsätzlich abgeltend mit einem Steuersatz von 25 % besteuert werden, sehen die Regelungen vor, dass Verluste aus Kapitalvermögen nur mit sonstigen positiven Einkünften aus Kapitalvermögen ausgeglichen werden dürfen. Eine zusätzliche Verlustverrechnungsbeschränkung gilt für Verluste aus der Veräußerung von Aktien; diese dürfen nicht mit anderen positiven Einkünften aus Kapitalvermögen, sondern nur mit Gewinnen, die aus der Veräußerung von Aktien entstehen, ausgeglichen werden.

Nach Auffassung des BFH bewirkt die gesetzlich vorgesehene Verlustverrechnungsbeschränkung eine verfassungswidrige Ungleichbehandlung, weil sie Steuerzahler ohne rechtfertigenden Grund unterschiedlich behandelt - je nachdem, ob sie Verluste aus der Veräußerung von Aktien oder aus der Veräußerung anderer Kapitalanlagen erzielt haben. Eine Rechtfertigung für diese Ausgestaltung der Verlustausgleichsregelung für Aktienveräußerungsverluste ergibt sich nach Gerichtsmeinung weder aus der Gefahr der Entstehung erheblicher Steuermindereinnahmen noch aus dem Gesichtspunkt der Verhinderung missbräuchlicher Gestaltungen oder aus anderen außerfiskalischen Förderungs- und Lenkungszielen.

The United States last week allowed Trinidad and Tobago to import gas from a Venezuelan offshore field but forbade the exchange of money.

Und er gab ein Beispiel: In Argentinien wurde Entel (ehemals ein staatliches Telekommunikationsunternehmen) in den 1990er Jahren zu 20 % von der Citibank gekauft, wobei 900 Millionen Staatsanleihen im Nennwert von etwa 160 Millionen Dollar eingesetzt wurden. Und 1992 wurde diese argentinische Firma von Telefónica übernommen, die einen Börsengang (öffentliches Aktienangebot) durchführte, und Citis Anteil an der privatisierten Firma wurde 560 Millionen Dollar wert.
